Debt Consolidation in California: Lending vs Debt-Service Checks
California distinguishes lending, debt settlement under the CCFPL, and organizations handling creditor payments under prorater rules and exemptions. Identify the service before checking authority; a credential for one activity does not answer every debt-relief licensing question.

Check Loan OptionsWhy does California require more than one category check?
DFPI lists Debt Settlement Services within its Covered Persons program under the California Consumer Financial Protection Law. Its current guidance points to definitions and exemptions. Check the actual settlement activity and claimed status through that program rather than assuming an ordinary lending credential answers the same question.

How does handling creditor payments change the question?
DFPI’s credit-counseling education distinguishes organizations that pay debts on a consumer’s behalf from counselors that only provide advice. It explains prorater licensing and qualifying nonprofit exemptions. Ask who holds money and distributes payments; then confirm the applicable status with DFPI rather than treating every counseling service as identical.

Which California resource should you use to clarify the provider?
DFPI’s Regulated Industries gateway separates consumer and commercial lending, covered persons, debt collection and prorater activities. Use the contract’s legal entity and service to choose a category. If the provider cites an exemption or a different registration, ask DFPI how to verify that claim; this page does not decide the legal status of a particular business.

Which record should you verify before paying or borrowing?
- Determine whether funds come from a new loan or your deposits to a service.
- Identify who handles and distributes creditor payments.
- Check the appropriate DFPI category, including applicable exemptions, rather than only a brand name.
| Mechanism | Evidence to obtain | Do not substitute |
|---|---|---|
| New consolidation loan | Legal lender, disclosures, sufficient net proceeds and completed payoff. | A service company’s proposed monthly deposit. |
| Creditor-repayment plan | Written participating-creditor terms, service charges and disbursement records. | A general nonprofit label or a promise that every creditor will agree. |
| Settlement service | Actual creditor agreements, fee terms and payment evidence. | A guaranteed percentage reduction or an advertised completion date. |
If the provider is a lender, the California personal-loan resource guide and 50-state lending directory explain lending categories. They are not a universal license check for debt-management or settlement services.
How should you compare the payment and full repayment?
State-specific service guidance does not establish an available loan rate or eligibility. Our national mathematical examples below provide the same $12,000 net proceeds with a 3% fee withheld from gross principal at a fixed 15% nominal annual rate. The figures are not California offers, rate limits or local market observations.
| Term | New loan payment | New total repayment |
|---|---|---|
| 36 months | $428.85 | $15,438.58 |
| 60 months | $294.31 | $17,658.50 |
The fee is financed inside gross principal; the nominal rate is not fee-inclusive APR. Use the original data and methodology for the assumptions, payment calculator for a basic estimate, and DTI overlap worksheet and cash-budget stress test for different affordability questions.
What are the scope and update limits?
This resource synthesizes the linked official guidance as checked October 23, 2026. It does not decide a company’s license, exemption, legal compliance or availability to a particular borrower. Financial-service categories and fee schedules can change; use the agency’s current instructions for the actual business and contract. Calculations use the published version 1.0.0 dataset, independently checked before publication.
